Heard learned counsel for the petitioner, learned standing counsel for State-respondents and Sri Sujit Kumar Rai, learned counsel for respondent-Bank.
Present petition has been filed seeking following relief:-
"i) Issue a writ, order or direction in the nature of certiorari quashing the recovery notice dated 09.07.2021 issued by the respondent No. 2 to the petitioner in tune of Rs. 19,544/-"
ii). issue a writ, order or direction in the nature of mandamus directing respondent No. 2 and 3 to decide the representation dated 12.07.2021 moved by the petitioner."
Learned counsel for the petitioner submitted that petitioner is entitled for loan waver scheme promulgated by Central Government, but without considering this fact, recovery notice dated 09.07.2021 of Rs. 19,544/- has been issued to him. For redressal of his grievance, he has moved representation dated 12.07.2021 before respondent No. 2, but till date no decision has been taken. Lastly, it is submitted that a direction may be issued to respondent No. 2 to decide the representation of the petitioner within a stipulated time for which learned counsels for respondents have no objection.
In view of the facts and circumstances of the case, with the consent of parties, without adverting on the merits of the case, the writ petition is disposed of directing respondent No.2 to decide the representation of the petitioner dated dated 12.07.2021 in accordance with law maximum within period of two months from the date of submission of certified copy of this order.
