One Sanjeev Kumar Jaiswal is the license holder of the Aara Machine (Saw Mill) bearing registration No. 4 of 2008. He has transferred his rights to run the said saw mill in favour of the petitioner. Therefore, petitioner has moved application dated 15.11.2019 to the Regional Forest Officer for substituting his name in the license of the aforesaid saw mill.
The grievance of the petitioner is that his aforesaid application is not being considered and decided.
According to the Standing Counsel, the proper authority to consider such an application is the District Forest Officer.
In view of the above, we dispose off the writ petition with liberty to the petitioner to move appropriate application for transferring the license of the aforesaid saw mill in his name before the District Forest Officer within a period of two weeks from today.
In case any such application is filed, the District Forest Officer shall consider and decide the same most expeditiously, if possible, within a period of next six weeks and in case he finds that the matter is to be considered by the Chief Forest Conservator, he may refer it to him who shall consider it most expeditiously again within a period of six weeks from the date of receiving the documents.
