Heard learned counsel for the applicant, learned AGA for the State and perused the record.
The present application has been filed by the applicant with the prayer to direct the Court below to expedite the S.T. No.157 of 2014 (State Vs. Naresh alias Ram Naresh and others) arising out of case crime no.312 of 2013, under Sections 302, 120B IPC, P.S. Bhatpar Rani, District Deoria, pending before the Additional Sessions Judge, Court No.15, Deoria within the stipulated period.
It is contended by learned counsel for the applicant that the applicant is the first informant in a murder case which was committed to the Court of Session in the year 2014 and the order sheet filed along with the affidavit reveals that the first date fixed for arguments on framing of charge was 29.7.2015 and since then for some reason or the other, charges have not been framed against the accused. The accused are pressuring the witnesses to enter into compromise.
Be that as it may, the case is fixed for framing of charge since 29.4.2015. It is really state of affairs that after more than two and half years, the charges have not been framed.
Without entering into the merits of the case, I deem it fit and proper to direct the trial Court to decide the aforesaid trial expeditiously strictly in accordance with law, preferably within a period of one year from the date of production of a certified copy of the order and decide the same on day today basis without granting unnecessary adjournment to either of the parties, under the provisions of Section 309 Cr.P.C., if there is no other legal impediment.
With the aforesaid observations, the application is finally disposed of.
