Heard Sri Rakesh Dubey, learned counsel for the applicant, Sri Ashish Pandey, learned A.G.A. for the State and perused the record.
It has been contended by the learned counsel for the applicant that the applicant alongwith her husband has been made accused in the present case the deceased used to come to the house of the applicant. He further submitted that the bail application of the husband of the applicant has already been rejected by this Court on 20.4.2015 vide Criminal Misc. Bail Application No.12499 of 2015. The applicant is in jail since 24.6.2014.
Learned counsel for the complainant as well as learned A.G.A. have vehemently opposed the prayer for bail and submitted that the deadbody of the deceased was recovered from the house of the applicant and there is no valid explanation given by the applicant or the co-accused. Cause of death is strangulation to which learned counsel for the applicant has vehementally argued that there appears to be a suicide note of the deceased which has been proved by the Investigating Officer hence the cause of death appears to be wrong one. It has been further submitted that all the witnesses of fact have been recorded and only formal witnesses are left.
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant Smt. Aneeta involved in Case Crime No. 1333 of 2014 under Section 302, 201 I.P.C., police station Loni, District Ghaziabad.
Accordingly, the bail application is rejected.
However, the trial court is directed to expedite the trial of the aforesaid case and conclude the same within preferably a period of four months from the date of production of a certified copy of this order, if, there is no legal impediment.
