Heard learned counsel for the revisionist and the learned A.G.A. for the State-respondents.
This revision has been filed praying for following relief:
"It is, therefore, Most Respectfully prayed that this Hon'ble Court may graciously be pleased to allow this Criminal Revision and set aside the impugned order dated 07/03/2017 passed by Learned Chief Judicial Magistrate Allahabad in Misc. Application No. 777/12 of 2016 (Anara Devi Versus Sukhdev and others) under section 156(3) Cr.P.C. Police Station Bahariya, District Allahabad, by which the Lower Court Below treated the application under Section 156(3) Cr.P.C. of the Revisionist and decline interim order of the opposite party no. 2 accused of the case.
And/or pass such other and further order which this Hon'ble Court may deem fit and proper under the facts and circumstances of the case."
The revisionist is a complainant who had filed Misc. Application No. 777/12 of 2016 under Section 156(3) Cr.P.C. During the pendency of the application, the revisionist had filed an application under Section 482 Cr.P.C. being Criminal Misc. Application No. 32993 of 2016 which was disposed of by this Court vide order dated 30.11.2016 with a direction to the court below to decide the application of the applicant/ revisionist under Section 156(3) Cr.P.C. in accordance with law, as expeditiously as possible, preferably within two months from the date of presentation of certified copy of order before the court concerned.
It appears that the application of the revisionist under Section 156(3) Cr.P.C. was considered and the same was registered as complaint case by impugned order dated 07.03.2017. The applicant has been directed to appear on 17.04.2017 for her statement under Section 200 Cr.P.C. Aggrieved with this order, the revisionist has filed the present revision praying to quash the said order.
I do not find any infirmity in the impugned order whereby a complaint case has been registered.
