In compliance of the earlier order of this Court, learned Standing Counsel has placed instructions before this Court today and the same is taken on record.
This petition under Article 226 of the Constitution of India as Public Interest Litigation has been filed for the following relief:
"(i) issue a writ, order or direction in the nature of mandamus directing the respondent no. 2 to decide the representation of the petitioner dated 05.12.2018 within stipulated time frame fixed by this Hon'ble Court which is pending before the respondent no. 2, during the pendency of the present P.I.L. writ petition before this Hon'ble Court (Annexure No. 5 to the writ petition).
From the report that has been brought on record by means of instructions it has been transpired that there is some restoration application filed by the person against the order passed under Section 67 of the U.P. Revenue Code, 2006 which is pending consideration before the authority concerned.
Since the matter is already engaging the attention of the authority designated under the U.P. Revenue Code, 2006, no further directions can be made in the present Public Interest Litigation for enforcement of an order. It is expected that the authorities shall proceed in accordance with law after the disposal of the restoration application filed by the person concerned.
