Learned counsel for the applicant does not dispute that under the provisions of the Criminal Procedure Code, a final order passed under Section 133 has to be enforced by the concerned S.D.M. In view thereof, the representation made to the District Collector would be of no avail.
Consequently and in the interest of justice, this petition shall stand disposed of with liberty to the applicant to approach the concerned S.D.M. by way of a detailed representation appending thereto the order under Section 133 which, according to him, has attained finality.
In case this application is made within a period of two weeks from today, the S.D.M. shall take cognizance of the same and proceed in the matter in accordance with law and dispose of the same preferably within a period of two months therefrom.
