When the Writ Petition is taken up for hearing, learned Senior Panel Counsel for Central Government appearing for the first respondent drew the attention of this Court to the counter affidavit of the first respondent, dated 24.12.2006, wherein it is stated that the third respondent has decided to re-float the tender and the re-tender was held on 20.10.2005 and the tender was awarded to M/s.Eswari Metal Industries, Mangalore. This statement made in the counter affidavit of the first respondent has not been disputed by the learned counsel for the petitioner. In view of the same, nothing further survives for consideration in this Writ Petition, which is accordingly closed. No costs. W.P.M.P. is closed.
