Heard learned counsel for the petitioner, Sri S. K. Gupta, learned counsel for respondent nos.3 and 5 and learned Standing Counsel for State authorities.
Petitioner's husband was working as Assistant Teacher and was assigned election duty in Panchayat Elections - 2020. It is contended that petitioner's husband has contracted Covid-19 and has died on 10.04.2021. It is stated that petitioner has made a representation to the District Magistrate concerned seeking benefit of the Government Order dated 01.06.2021, which provides for grant of ex gratia payment to the victims of Covid-
19 Pandemic. Grievance is that although petitioner has represented to the concerned District Magistrate but no action has yet been taken by the authority concerned on her application and she has not been released any ex gratia payment.
Learned counsel for respondents submits that no useful purpose would be served in keeping the writ petition pending and appropriate directions may be issued to the concerned District Magistrate, who may decide the claim of the petitioner.
In this view of the matter, without expressing any opinion on the merits of the case, the writ petition is disposed off directing the respondent no.2 to consider the pending application of the petitioner for grant of ex gratia payment under the Government Order dated 01.06.2021 and pass appropriate order, as expeditiously as possible, preferably within a period of one month from the date of production of certified copy of this order considering all the aspects of the case in accordance with law. Liberty stands reserved to petitioner to annex all materials in support of her claim alongwith copy of this order.
