1. These petitions are directed against the award dated 09.12.2010 passed by the Labour Court, Dahod in Reference (LCD) No. 849 & 853 of 2008 (Old Reference No. 223 & 227 of 2003) by which the Labour Court directed the petitioner to reinstate the respondents on their original post with continuity of service and 20% backwages and consequential benefits etc. The Labour Court also imposed Rs. 1501/- towards costs.
2. In view of the court's suggestion put forward to both the sides, the respondents have agreed to accept lumpsum amount as full and final settlement in lieu of reinstatement, continuity of service, backwages and other consequential benefits. Accordingly, with the consent of the parties the following order is passed:
The petitioner shall pay the respondents an amount of Rs. 1,65,000/- each as full and final settlement in lieu of reinstatement, continuity of service, backwages, consequential benefits and costs.
The said payment shall be made within a period of six weeks from today.
If the petitioner fails to pay the amount before 28.05.2012, it shall be open to the respondents to revive these petitions for appropriate orders.
The award of the labour court is substituted accordingly.
3. Rule is made absolute to the aforesaid extent. No costs.
