Heard the petitioner in person, learned Standing Counsel for the State respondents and Sri Avneesh Tripathi who appears for the Commission.
The petitioner is aggrieved by the fact that he was not invited by the Commission to participate in the interview which was held in connection with the appointment of Additional Director (Law). The principal contention of the petitioner was that no screening test was conducted by the Commission before calling candidates for the interview.
Sri Tripathi learned counsel on instructions apprises the Court that as is evident from a reading of clause 7, it is not mandatory for the Commission to hold a screening test. It is submitted that it is only in a situation where a large number of candidates apply for posts and the Commission deems it necessary to screen and shortlist candidates that such a procedure is followed. The aforesaid submission commends acceptance also from a bare reading of clause 7. The Court is further apprised that the last candidate who was invited by the Commission for interview had obtained 66% marks at the graduation level whereas the petitioner had obtained only 56.6%. It was in the aforesaid backdrop that Sri Tripathi contends that the petitioner was not called for the interview. The Court finds no error in the procedure as adopted by the Commission.
The writ petition fails and is dismissed.
