Heard Sri Sudhanshu Singh, learned counsel for the applicants and Sri G.P. Singh, learned A.G.A for the State and perused the record.
This application under Section 482 Cr.P.C. has been filed for quashing the summoning order dated 30.08.2018 passed by Judicial Magistrate, Kannauj as well as entire proceedings of Complaint Case No. 710/2018 u/ss. 147, 323, 324, 504, 452 IPC, PS. Indergarh, District Kannauj.
Learned counsel for the applicants submits that twice final report was submitted in the matter and some persons from petitioner's side have also received injuries. It is further stated that after submission of the final report, opposite party no.2 did not contest the final report and has filed the present complaint for prosecution of the applicants.
Learned counsel for the complainant submits that both sides have received injuries and there are cross reports of the incident in question.
After having heard learned counsel for the parties present and perused the impugned order as well as the material brought on record, I am of the view that the impugned order is based upon relevant considerations and supported by cogent reasons, the same does not suffer from any irregularity, illegality or jurisdictional error, hence no interference is required by this Court. The prayer for quashing the impugned order is refused.
The present 482 Cr.P.C. application lacks merit and is, accordingly, dismissed.
