Heard Sri K.K. Mani holding brief of Sri Ravindra Prasad, learned counsel for the applicant and Sri S.P. Singh, learned A.G.A. for the State.
The only prayer made by the applicant is that a direction be issued to the court below to expedite the proceedings of Complaint Case No. 1100 of 2016 under Section 12 of D.V. Act pending in the Court of A.C.J.M-IInd, Gorakhpur (presently in the Court of A.C.J. (S.D., Fast Track Court, Gorakhpur) and decide the application for interim maintainance of applicant/wife.
Considering the facts of the case, without expressing any opinion on the merits of the applicant's case, this application U/s 482 Cr.P.C. is finally disposed of with a direction to the court below to decide the application for interim maintainance of applicant/wife in accordance with law without granting unnecessary adjournments to either of the parties as expeditiously as possible preferably within a period of one month from the date of production of certified copy of this order, if there is no legal impediment.
