1. RULE.
Mr. Ronak Raval, learned AGP waives service of Rule on behalf of respondent No.4. Learned advocate Ms. Lopa Bhatt for learned advocate Mr. Mahendra Trivedi for respondent No.3 states that she has no instructions and Mr. Trivedi now no more appears even though the record shows that a copy of the Civil Application has been served upon Mr. Trivedi. Considering the fact that the present application is filed only for fixing the main matter i.e. Special Civil Application No.3168 of 2001 for final hearing which is pending since 2001, presence of respondent No.3 is not necessary at this stage.
2. Having heard the learned counsel appearing for the respective parties and considering the averments made in the application, the application deserves to be allowed and is hereby allowed. The main matter being Special Civil Application No.3168 of 2001 is fixed for final hearing in the week beginning from 16.7.2012.
3. With these observations, this application is allowed to the aforesaid extent. Rule is made absolute accordingly with no order as to costs.
