Heard Shri Pratap Kanchan Singh, learned counsel for the appellant and learned A.G.A., on the Criminal Misc. Bail Application No. 1A/1 of 2018 (Amrik Singh vs. State of U.P.).
This bail application is moved by the appellant for bail in Special Session Trial No. 29 of 2014 (State vs. Amrik Singh) under section 8/18(b) of N.D.P.S. Act, Crime No. 54 of 2014, Police Station- Chandausi, District- Muradabad, during the pendency of this Criminal Appeal before this Hon'ble High Court.
Learned counsel for the appellant submitted that as per prosecution case 30 packets of poppy straw were recovered from the accused-applicant / appellant and each packet was having the weight of 40 kg but the sample 200 gram is taken out only from one packet.
Considering these fact, in my opinion, the bail application deserves to be allowed.
Hence, the Criminal Misc. Bail Application No. 1A/1 of 2018 is allowed.
Let the accused-applicant/appellant Amrik Singh be enlarged on bail in Special Session Trial No. 29 of 2014 (State vs. Amrik Singh) under section 8/18(B) N.D.P.S. Act, Crime No. 54 of 2014, Police Station-Chandausi, District- Muradabad, during the pendency of this appeal on his personal bond of Rs. 1,00,000/- and two sureties of the like amount each to the satisfaction of the Court concerned.
The realization of half amount of the fine is stayed during the pendency of this appeal provided the appellant deposits the rest half amount of the fine i.e. Rs. 50,000/- in the Court concerned at the time of his release on bail.
Reminder be issued to the Court concerned for sending the lower Court record, expeditiously, through special messenger.
