By means of the present writ petition the petitioner is seeking to challenge the show cause notice dated 18.03.2021 whereby the shop in question has been suspended on the prima-facie allegations levelled thereon.
Learned counsel for the petitioner submits that the petitioner has submitted a detailed reply on 27.03.2021 but nothing has been done in the matter. The last date fixed was 28.05.2021 but there is no fresh date fixed by the respondent no. 2.
It is contended that the respondent no. 2 had illegally passed the suspension order based on the report of the District Excise Officer without any evidence.
Be that as it may, as the challenge is to show cause notice we find no reason to keep the writ petition pending.
The writ petition is being disposed of with the observation that the respondent no. 2 shall take expeditious decision by passing a reasoned and speaking order in accordance with law considering the reply submitted by the petitioner to the show cause notice dated 18.03.2021 preferably within a period of four weeks from the date of receipt of a copy of this order.
