The petitioner claims that she should be paid compensation on account of acquisition of land in which she is one of the co-sharers.
Learned counsel for the respondent nos. 1 to 3 submitted that there is a dispute amongst the petitioner and respondent no. 4 regarding entitlement of compensation, hence the same shall be referred to the Court of competent jurisdiction in terms of Section 3H(4) of the National Highways Act, 1956 (hereinafter referred to as the 'Act of 1956') within a period of two months from the date of receipt of a copy of this order.
After hearing learned counsel for the parties, the present petition is disposed of with the direction to the respondent no. 3 to refer the dispute under Section 3H (4) of the Act of 1956 to the Court of competent jurisdiction from the date of receipt of a copy of this order.
