Rule.
Mr. J.K.Shah, learned APP waives service of notice for respondent - State of Gujarat.
At the joint request of learned advocate for the petitioner, this matter is taken up for final disposal.
The petitioner has filed this petition with a prayer to modify the condition No.7[c] imposed in the order dated 28.04.2011 passed by this Court in Criminal Misc. Application No.5868 of 2011 and to permit him to change his residence for the reasons mentioned in paras 4 and 5 of the petition.
Having heard learned advocate for the petitioner and learned APP and considering the facts and circumstances of the case, I am inclined to grant permission to the petitioner to change his residence and the new residential address be furnished to the Investigating Officer or In-charge of the nearest police station and the concerned court.
With the aforesaid this petition is allowed. Other conditions imposed in order dated 28.04.2011 passed in Criminal Misc. Application No.5868 of 2011 shall remain as they are.
Rule is made absolute to the aforesaid extent only.
Direct service is permitted.
