Heard Mr. Kartikeya Saran, learned counsel for the petitioner and Mr. Birendra Singh, learned counsel for respondent No. 7.
The principal prayer made in the writ petition reads thus:
"i. issue a writ, order or direction in the nature of mandamus commanding the respondent nos. 3 and 4 to enquire into the illegal construction of road over the land leased to the petitioner, being Gata Nos. 739, 740, 741, 742Ka and 743 in Village Durendi, District Banda."
Counsel appearing for respondent No.7, on instructions, submits that respondent No.7 has not taken any steps/made any construction of road passing through Gata Nos. 739, 740, 741, 742Ka and 743, situated in Village Durendi, District Banda. He further submits that respondent No.7 shall not make construction of road passing through the lands of any private individuals without prior permission, if any, required under the provisions of the Uttar Pradesh Minor Minerals (Concession) Rules, 1963. His submissions are recorded and accepted. In view thereof, nothing further survives in the writ petition. Petition is accordingly disposed of.
