Heard Mr.NM Amin, learned advocate for the applicants, Mr.DK Prajapati, learned advocate for respondent No.1 and Mr.Raval, learned APP for the respondent No.2 - State. Mr.Raval, learned APP for respondent No.2 - State submitted a report prepared by the Dy.S.P., Kalol Division addressed to the office of Public Prosecutor, Gujarat High Court dated 2/6.2.2012 pursuant to the earlier application dated 20.12.2010 referred in the FIR, which was forwarded to police by the respondent No.1 - original complainant for taking action against the applicants.
Having considered the submissions advanced on behalf of both the sides, so also considering the papers annexed with this application, and more particularly, considering the aforementioned report submitted by Mr.Raval, learned APP, the matter requires detailed consideration. Hence, rule, returnable on 14.03.2012. Mr.Prajapati, learned advocate waives service of rule for respondent No.1 and Mr.Raval, learned APP waives service of rule for respondent No.2 - State. The ad-interim relief earlier granted shall continue till further orders. The communication dated 2/6.2.2012 tendered for perusal by Mr.Raval, learned APP, shall be retained on record.
