Supplementary affidavit, filed by learned counsel for the applicants, is taken on record.
Heard learned counsel for the applicants and learned A.G.A for the State as also perused the record.
This application under Section 482 Cr.P.C. has been filed seeking direction to the court below for early decision of Case No. 433 of 2018, arising out of Case Crime No. 266 of 2018, under Sections- 147, 149, 186, 189, 332, 352, 393, 504, 506 I.P.C. I.P.C., Police Station- Ahraura, District- Mirzapur, pending before the 2nd Additional Chief Judicial Magistrate, Mirzapur.
Learned counsel for the applicants has submitted that the present case is pending since 2018 before the court concerned and trial of the case could not proceed expeditiously due to unnecessary adjournment. It is further submitted that the applicant No.2 has been appointed in Northern Coalfields Ltd., hence it is necessary to expedite the trial of the aforesaid case.
Considering the fact that the trial has remained pending since 2018, without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the court below to decide the aforesaid case in accordance with law, as expeditiously as possible, without granting any unnecessary or long adjournments to either of the parties, if there is no other legal impediment.
