This application u/s 482 Cr.P.C. has been filed seeking the direction to the Additional Civil Judge (Prawar Khand)/Additional Chief Judicial Magistrate, Court No.2, Ghaziabad to decide the proceedings of Complaint Case No.2873 of 2017 (136/2009) (Amit Sharma vs. Rachana Agrawal), u/s 138 N.I. Act, P.S.-Kavi nagar, District-Ghaziabad expeditiously within stipulated period.
Heard applicant's counsel and learned A.G.A. for the State. Record has been perused.
It has been pointed out by the counsel for the applicant that complaint is pending since 2009. It is surprising to see as to how and under what circumstances the complaint has been allowed to drag on for such a prolix period of time, but in the absence of complete record, this Court is not in a position to exactly gauge the reasons why the proceedings have not been concluded so far.
In any view of the matter, the lower court concerned is required to look into the matter as most urgent and take adequate steps to expedite the proceeding and bring them to a logical conclusion with dispatch, without granting any unnecessary adjournment to either of the parties, unless there is some legal impediment or unless there is any order passed by the higher court staying the proceedings of the case.
With the aforesaid observation this application is disposed off.
