After arguing the appeal at length, learned Counsel for the appellant prays for withdrawal of the appeal with liberty to challenge the statute of the University in reference to the provisions for compassionate appointment. The dismissal of the writ petition or withdrawal of the appeal may not come in the way of the petitioner.
The appeal is dismissed as withdrawan with the liberty, as prayed.
The dismissal of writ petitioner or withdrawal of the appeal would not come in the way of the petitioner for challenge to the statute and for consequential relief.
