Heard learned Standing Counsel for the opposite party.
By means of this contempt application under Section 12 of the Contempt of Court of Act non compliance of the order Writ Court dated 24.10.2019 passed in Writ A No. 1124 of 2019 is complained of.
From perusal of the order dated 27.10.2018, it is clear that the order was to the effect that the applicant shall make representation alongwith certified copy of the order of Writ Court within period of two weeks raising all his grievance and same shall be examined by the competent authority within a specified period of time.
Learned Standing Counsel in compliance of earlier order of the Writ Court has filed compliance affidavit in which the order dated 07th February, 2021 passed by Principal Secretary, Transport Department Government of U.P., Lucknow, has been annexed and in which representation of the applicant on all points raised, has been duly considered and disposed of.
From perusal of the order dated 07th February, 2021, I find that the representation of the applicant has been considered on merits and has stood disposed of and since Writ Court had not applied its mind to merit of the claim of the applicant, it will be open for the opposite party to deal with the matter in accordance with law and I find that due application of mind is rendered in disposing of the representation of the applicant by the competent authority, namely, opposite party.
In view of above, no cause survives to maintain the contempt application. Notices issued, if any, stands discharged.
The contempt application is consigned to records.
