Heard learned counsel for the petitioner, learned A.G.A. for the State and Sri Brijesh Kumar Srivastava, for respondent no.3.
A joint submission has been made by learned counsel for the parties that the petitioner and the respondent no.3 have solemnized marriage and are living together and the impugned F.I.R. was lodged by respondent no.3 under the pressure of her father.
Both the petitioners are present in the Court today. Respondent no.3-Km. Rajina who has been identified by her counsel- Sri Brijesh Kumar Srivastava, on being questioned by the Court, she stated the same facts which was submitted by the counsel for the parties. She further stated that the petitioner had not raped her.
In view of the statement made by the respondent no.3 Km. Rajina before this Court, we are of the view that no useful purpose would be served in proceeding this matter any further.
Writ petition accordingly stands allowed and the impugned F.I.R. is hereby quashed.
