Heard Sri Satyajeet Mukherjee, learned counsel for the petitioner and learned Standing Counsel for the State- respondent.
This writ petition has been filed with the following prayer:-
"a). Issue a writ, order or direction in the nature of mandamus commanding the District Magistrate, Allahabad, respondent no.2 to decide the petitioner's application dated 29.05.2019 (Annexure no.8 to the writ petition) and issue a fresh Arms Licence to the petitioner, in lieu of the earlier Arms Licence bearing No.SWDC/8/1994/504 (old no.SWDC080504) issued by the Licensing Authority at New Delhi, forthwith."
It is contended by learned counsel for the petitioner that the petitioner is an ex-army man and his earlier licence was issued by the Licensing Authority at New Delhi. On 29.05.2019 petitioner has moved a fresh application for grant of fire arms licence which is pending consideration till date.
Learned Standing Counsel does not oppose the same.
As no useful purpose would be served in keeping the matter pending, with the consent of the parties, the matter is being disposed of at this stage without calling for counter affidavit, directing the Licensing Authority i.e. respondent no.2 is directed to consider the application of the petitioner, if there is no legal impediment and after hearing all the concerned parties, strictly in accordance with law by reasoned and speaking order, expeditiously, preferably within a period of six months from the date of production of copy of this order, downloaded from the official website of Allahabad High Court.
