Heard learned counsel for the applicants, learned AGA and perused the material on record.
By means of the instant application, learned counsel for the applicants has prayed for setting aside cognizance order dated 26.07.2018 as well for quashing the charge sheet dated 17.06.2018 along with the entire criminal proceedings initiated in SST No. 54 of 2018 (State v. Amardeep Pandey @ Sanni and another) arising out of Case Crime No. 16 of 2018, under sections 323, 363, 366, 376 IPC and 3/4 of the Protection of Childrent from Sexual Offences Act, P.S. Dakshin Tola, District Mau pending in the court of the I-Additional Session Judge, Mau.
Learned counsel for the applicants instead of pressing the aforesaid prayer, fairly conceded that the applicants have already been bailed out in the instant case and now are desirous to file discharge application in the court court, therefore, appropriate directions be given to the court concerned to adjudicate and decide the same in a stipulated period.
In the aforesaid backdrop, if the applicants move discharge application in the aforesaid sections within four weeks from today, the court concerned is directed to decide the same by passing speaking and reasoned order in accordance with law, within a period of six weeks thereafter.
With the aforesaid direction, the instant application under section 482 Cr.P.C., is finally disposed of.
