Heard learned counsel for the petitioner.
Learned Standing Counsel has accepted notices on behalf of respondents No.1 to 3 and Sri Arun Kumar Srivastava, learned counsel has accepted notice on behalf of respondent no.4.
The petitioner has preferred the present writ petition with the following main prayers :-
"i. to issue a writ, order or direction in the nature of mandamus commanding and directing the respondent no.3 to consider and decide the objection of the petitioner dated 1.1.2019 u/s 9 of the U.P. Consolidation of Holdings Act, 1953 (Annexure no.6 to the writ petition) after calculating the valuation of the land shown in C.H. form 5 expeditiously within the specified period to be stipulated by this Hon'ble Court ;
ii. to issue a writ, order or direction in the nature of mandamus commanding and directing the respondent no.3 to decide the applications of the petitioner dated 22.7.2019 and 30.8.2019 (Annexure nos.8 and 9 to the writ petition) expeditiously within the specified period to be stipulated by this Hon'ble court ;"
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the petition stands disposed of finally with a direction to the respondent no.3/Consolidation Officer, 4th, District Moradabad to consider and decide the aforesaid objection after evaluating the plot of the petitioner in accordance with law expeditiously and preferably within a period of three months from the date of production of certified copy of this order but certainly after giving opportunity of hearing to the parties concerned without granting unnecessary adjournment to either of the parties, except upon payment of cost.
