Heard learned counsel for the applicant and learned AGA for the State-respondents.
The present bail application has been filed for enlarging the applicant on bail in Case Crime No. 332 of 2017, under Sections 379, 411, 413, 414, 420, 467, 468, 471 I.P.C., Police Station Galshaheed, District Moradabad.
It is contended by learned counsel for the applicant that the applicant is innocent and has falsely implicated in the present case. After arrest in the present case, he has been falsely implicated by the police in five other cases. It is next submitted that alleged recovery of five motor cycle is frivolous and applicant is languishing in jail since 04.09.2017.
Per contra, learned A.G.A. has vehemently opposed the bail application and informed that earlier 5 FIRs of theft of motor cycle have been lodged, which are recovered on the pointing out of the applicant and connected with those cases, which shows that applicant is a habitual offender. Therefore, no case is made out for granting bail.
Considering the facts and circumstances of the case, criminal history of the applicant, the gravity of the offence, the nature of accusations and severity of punishment in case of conviction, there does not appear any good ground to release the applicant on bail.
At this juncture, learned counsel for the applicant prayed that the trial is proceedings at snail's speed, hence the trial court be directed to conclude it within some time bound period.
Keeping in view that the applicant is in jail since 04.09.2017, the trial court is directed to make all possible efforts to conclude the trial expeditiously, if possible, within a period of six months from the date of production of certified copy of this order.
With the aforesaid observations, the bail application is rejected. Order Date :- 28.7.2021 Arvind
