Vakalatnama filed by Sri P.K. Sharma, Advocate on behalf of the opposite party No.2 is taken on record.
This court in normal course would have issued notice to the opposite party No.2 in the matter but since the complainant is already represented through his counsel, namely, Sri P.K. Sharma, Advocate, there is no need to issue notice.
It is admitted to Sri P.K. Sharma, learned counsel for the opposite party No.2 that two other co-accused persons have already been granted bail in connection with the same case crime No.432 of 2018 under Sections 379, 411, 420, 467, 468 and 471 I.P.C., Police Station- Gurusahaiganj, District- Kannauj.
Learned Additional Government Advocate also does not dispute the above factual position.
In view of the above, the case of parity is made out and the applicant is entitled to be enlarged on bail.
Let the applicant- Aman Gihar involved in aforesaid case be released on bail on his executing a personal bond and furnishing two sureties each of the like amount to the satisfaction of the court concerned. However, applicant has been directed to be enlarged on bail with condition that he shall appear before court concerned as and when required and shall not avoid personal appearance, failing which, court below will be at liberty to cancel the bail.
It is also directed that identity status and residence proof of the applicant and sureties be strictly verified by the court concerned before the bonds are accepted.
The criminal revision, accordingly, stands disposed of.
