Supplementary affidavit as well as impleadment application filed today is taken on record.
Heard Sri Rakesh Pande, learned Senior Advocate assisted by Sri S.M. Khan, learned counsel for the petitioner, Sri Shakti Nigam, learned Senior Advocate assisted by Sri Vivek Prakash, learned counsel for the respondents and perused the record.
The controversy as sought to be raised in the present is case already engaging the attention of this Court in a pending writ petition being Writ-C No.- 34854 of 2012 and in which impleadment application has also been moved by the respondents and the same has already been allowed.
From the perusal of the order dated 6th February, 2018, it clearly transpires that the controversy pertaining to the land in the present case is the same one as involved in Writ- C No.- 34854 of 2012.
In our considered opinion, if the petitioner has grievance by any subsequent activity or any action, it is proper for him to pursue the pending writ petition by moving an urgent application in the pending writ petition.
This writ petition is, accordingly, dismissed.
