After the petitioner's name was mutated on 23.5.2011, it has been alleged that the respondents filed an Appeal being Appeal No. 63 of 2011 (Computerized Case No. T20110520198).
The contention of the learned counsel for the petitioner is that the Appeal was lingering since 2011 and was not being decided. Further contention of the learned counsel for the petitioner is that there was an interim order operating in favour of the respondents which was working against the interest of the petitioner.
Therefore, a prayer has been made that a direction be issued that the Appeal being Appeal No. 63 of 2011 (Computerized Case No. T20110520198) be decided expeditiously within a stipulated period of time.
Under such circumstances, without going into the merits of the case, it is being directed that the Appeal being Appeal No. 63 of 2011 (Computerized Case No. T20110520198) be decided within a period of three months from the date of production of a copy of this order, if there is no other legal impediment. The copy of this order would be duly certified by the petitioner's counsel.
The writ petition is disposed of.
