This is an application seeking to expedite proceedings of Case No. 216/XI of 2017, Smt. Alka Sharma vs. Manoj Sharma, under Section 125 Cr.P.C. pending before the Principal Judge, Family Court, Mathura. It is submitted by the learned counsel for the applicant that proceedings of the maintenance case are lingering on. Learned counsel for the applicant has taken this Court through the order sheet. It does appear that proceedings of the case are lingering on.
The proceedings under Section 125 Cr.P.C. have an inherent element of urgency as these are designed to bring immediate relief to a wife or the dependent entitled, who has no means of sustenance.
Looking to the nature of the order that this Court proposes to pass, no notice is being issued to opposite party no. 2. However, in case the said opposite party feels aggrieved by the order made today, it is open to him to make an application in this decided matter.
In the circumstances, it is directed that the learned Principal Judge, Family Court, Mathura shall endeavor to conclude the proceedings of Case No.216/XI of 2017, Smt. Alka Sharma vs. Manoj Sharma, under Section 125 Cr.P.C., Police Station Sadar Bazar, District Mathura and decide the same expeditiously within three months next without granting any unnecessary adjournment to either of the parties.
It is further provided that application for interim maintenance, if any, filed on behalf of the applicant shall be disposed of within a period of one month next positively from the date of receipt of a copy of this order.
With the above orders, this application stands disposed of.
