Heard learned counsel for the petitioners and perused the record.
By means of this petition under Article 227 of the Constitution, the petitioners have prayed for following relief:-
"(i) Issue an order or direction to direct the Civil Judge (Junior Division), Mohammadabad, Ghazipur to decide the Misc. Application No.65/2017 (Alamgir Vs. Irshad Ansari & others) under Rule 2A order 39 CPC, in Original Suit No.195/2016 (Alamgir Vs. Irshad Ansari & Ors), pending before the Civil Judge (Junior Division) Mohammadabad, Ghazipur, within stipulated period or as early as possible."
Considering the overall facts and circumstances of the case, this petition is disposed of with a direction to the court concerned to conclude and decide the aforesaid application strictly in accordance with law and after recording satisfaction regarding service of summons and giving full opportunity of hearing to the appearing parties, as expeditiously as possible preferably within a period of thre months positively from the date of production of copy of this order.
Copy of the order available on the official website of the High Court will be taken to be authentic one.
