M/S Alagu G.G.Granites vs The State Of Tamil Nadu

Madras High Court|08 June, 2017

JUDGMENT / ORDER

The petitioner seeks for a Mandamus directing the first respondent to consider and pass orders on the petitioner's application dated 01.03.2016 seeking lease of the quarry by taking note of their further representation dated 27.02.2017 in respect of their patta lands measuring 4.16.0 hectares comprised in S.F.Nos.505/1, 505/3, 509/1, 509/2, 510, 511 & 571/4, situated in Pilathu Village, Vedasandur Taluk, Dindigul District.
2. The grievance of the petitioner is that the said application has not been considered by the first respondent so far inspite of the representation dated 27.02.2017. Needless to say, it is for the first respondent to consider and decide as to whether the petitioner is entitled to quarry lease or not and therefore, this Court, at this stage, is not expressing any view on the claim made by the petitioner, except directing the first respondent to consider the representation of the petitioner dated 27.02.2017 and pass orders on the same on merits and in accordance with law. Such exercise shall be done by the first respondent within a period of six weeks from the date of receipt of copy of this order. Accordingly, the writ petition is disposed of. No costs.
