The present writ petition has been filed challenging the order dated 24.3.2021 passed by the Consolidation Officer in proceedings registered under Section 9-A of the U.P Consolidation of Holdings Act, 1953 (hereinafter referred to as Act, 1953).
Against the aforesaid order, the petitioner has the remedy to file an appeal before the Settlement Officer of Consolidation under Section 11(1) of the Act, 1953.
The claim of the petitioner that the Consolidation Officer did not have the jurisdiction to pass the order dated 24.3.2021 can also be considered by the Settlement Officer of Consolidation.
In view of the availability of alternative remedy to the petitioner, it is not a fit case for interference under Article 226 of the Constitution of India at this stage.
The writ petition is dismissed.
