Rejoinder affidavit filed today is taken on record.
Heard Sri Ashutosh Srivastava, learned counsel for the petitioner as well as Sri Shashi Prakash Singh, learned Senior Counsel assisted by Sri Krishna Agarwal, learned counsel for the respondents and perused the record.
Present petition has been filed challenging the impugned order dated 13.1.2021 passed by Assistant Record Officer, Gautam Buddh Nagar in Case No. 001 of 2019-20-21 (Government of India, Defence Ministry vs. State of UP) under Section 49 of Uttar Pradesh Revenue Code, 2006 so far it relates to the petitioner.
Sri Shashi Prakash, learned Senior Counsel for the respondents states that identical controversy in Writ-C No. 3699 of 2021 has been dismissed on merits on 27.7.2021. A copy of the status of the said case has been placed before this Court.
At this stage, learned counsel for the petitioner submits that the present petition may be dismissed as withdrawn.
Accordingly, present petition is dismissed as withdrawn. No order as to costs.
