The instant application under section 482 Cr.P.C has been filed by the applicant with a prayer for expeditious disposal of the proceeding pending in case no. 605 of 2017, under section 125 Cr.P.C. (Smt. Ajamtun alias Asamtun Nisha Vs. Rashid Ulla).
Heard Sri Vijay Kumar Tiwari,learned counsel for the applicant and learned A.G.A. for the State.
Learned counsel for the applicant has submitted that the applicant is legally weeded wife of the opposite party No.2. She has no source of income whereas the opposite party No.2 is doing job in A.G.Office at Allahabad. The maintenance application filed by the applicant under section 125 Cr.P.C is pending since 2017 and no effective order has been made, hence a direction be given to the Principal Judge, Family Court, Allahabad for expeditious disposal of the maintenance application.
Learned A.G.A has vehemently opposed the prayer made by the learned counsel for the applicant.
Looking into the facts and circumstances of the case, the learned Principal Judge, Family Court, Allahabad is directed to look into the matter and decide the same preferably within a period of three months from the date of production of certified copy of this order, in accordance with law.
With the aforesaid direction/ observation the application under section 482 Cr.P.C is disposed of.
