Heard learned counsel for the petitioner and learned Standing counsel for the State-respondents.
The petition has been filed seeking the following relief-
"i) issue a writ, order or direction in the nature of mandamus directing the respondents to demarcate the Arazi No.652/3/1/2/2.3, 652/3/1/3/0.22 and 682/2/4/0/11 situated in village Belchha, Pargana Haveli Tehsil Sadar, District Jaunpur."
On the basis of the submissions made as also from the material on record, it appears that the petitioner has filed an application before the Consolidation Officer seeking demarcation of the plot aforesaid.
In my considered opinion, the Consolidation Officer is not competent to order any demarcation. Any demarcation, is desired by the petitioner is permissible only under Section 24 of the U.P. Revenue Code 2006. However, this provision has no application, in case, the village is under consolidation operations.
Subject to the above, this writ petition is dismissed.
