Heard learned counsel for the applicant and learned A.G.A for the State as also perused the record.
This application under Section 482 Cr.P.C. has been filed seeking direction to the court below for early decision of S.T. No. 713 of 2013 (State Versus Ajeet Kumar Verma), under Sections 363, 366 I.P.C., Police Station Georgetown, District Allahabad, pending in the court of A.D.J./F.T.C, court no. 20, Allahabad.
Learned counsel for the applicant states that earlier, the applicant had approached this Court by means of application u/s 482 Cr.P.C. No. 14536 of 2017, which was disposed of by the following order:
"Heard learned counsel for the applicant and learned A.G.A. for the State.
By means of the present petition, the applicant has sought for a suitable direction to the learned Additional District Judge/F.T.C.-20 Allahabad to consider and decide the Sessions Trial No. 713 of 2013 arising out of Case Crime No. 113 of 2008 under Sections 363, 366 I.P.C., Police Station George Town, District Allahabad, within the time stipulated by this Court.
No useful purpose would be served in keeping the petition pending, which is finally disposed of with a direction to learned Additional District Judge/F.T.C.-20 Allahabad to consider and decide the Sessions Trial No. 713 of 2013 arising out of Case Crime No.
113 of 2008 under Sections 363, 366 I.P.C., Police Station George Town, District Allahabad, most expeditiously, in accordance with law, after hearing the concerned parties, without granting unnecessary adjournment to either of the parties, in case the proceedings of the aforesaid case, is not stayed by any Court."
However, the trial is still pending and the applicant who is serving in the Indian Army is facing continued harassment, though the alleged victim continues to live with the applicant as a married wife and they have children from such marriage.
Considering the fact that the trial has remained pending since 2013 and without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the court below to decide the aforesaid case in accordance with law, without granting any unnecessary or long adjournments to either of the parties, as expeditiously as possible, preferably within a period six months from the date of production of a certified copy of this order, if there is no other legal impediment.
