JUDGMENT / ORDER

It is submitted by learned counsel for both the respective parties that they will give full co-operation for disposal of the suit.
If necessary direction is given to the Trial court for expeditious disposal of the suit, they will not invite any reasoned order.
Learned 10th Additional Senior Civil Judge, Surat is hereby directed to decide the Special civil Suit No. 60 of 2003 expeditiously preferably within six months from the date of receipt of the present order and R & P.
Trial court will dispose of the suit in accordance with law without being influenced by the order passed by the Trial court below (Exh.5) injunction application, as well as order passed by this Court today.
In view of the above, Appeal from Order, as well as Civil Application is disposed of. Office is directed to immediately send R & P. of Special civil Suit No. 60 of 2003 to the Trial court.
Direct Service is permitted.
