Heard Sri Siddharth Nandan, learned counsel for the petitioner and Sri Ashish Mishra, learned counsel appearing for respondent no. 2.
The petitioner has filed this petition for a direction upon respondent no. 2 to disclose the marks obtained by him in the U.P. Higher Judicial Service Recruitment Examination-2018 Part-I and Part-II and to disclose the cutoff marks of the candidate in each category, on which select list has been made.
The petitioner can seek the aforesaid information by filing appropriate application under Right to Information Act, 2005 read with High Court Right to Information Rules, 2006.
The other prayer for framing rules as advised by the petitioner is completely misconceived inasmuch as, the recruitment has to be made according to the rules and the petitioner has no right that a rule should be re-framed in any particular manner.
In view of the alternative remedy so available to the petitioner, we dispose off the petition with liberty to the petitioner to avail the said remedy.
