By order dated 29.7.2016 Standing Counsel was granted four weeks' time for filing counter affidavit but counter affidavit could not be filed.
The writ petition has been filed against the order of District Magistrate dated 18.6.2012 canceling arms licence of the petitioner and the Commissioner dated 29.4.2016 dismissing the appeal of the petitioner against the aforesaid order.
The arms licence of the petitioner has been cancelled on registration of Case Crime No.217 of 2011 under Section 324, 504, 506, I.P.C. in which later on charge sheet has been submitted under Section 307/504 IPC. During pendency of the writ petition the petitioner has been acquitted in the aforesaid case by judgment dated 27.11.2017 of Additional Sessions Judge.
In the facts of the case the matter is remanded to the District Magistrate to reconsider it in the light of the judgment date 27.11.2017 of Additional Sessions Judge and pass a fresh order in respect of cancellation of arms licence in accordance with law, within a period of two months from the date of production of a certified copy of this order before him and order of District Magistrate dated 18.6.2012 and Commissioner dated 29.4.2016 shall be abided by the fresh order passed by District Magistrate.
The writ petition is disposed of.
