Heard learned counsel for the petitioners and the learned A.G.A.
This writ petition has been filed praying for the following reliefs:
"(i) A writ, order or direction in the nature of certiorari quashing the impugned First Information Report dated 4.11.2020 registered as Case Crime No. 659 of 2020, under Section 406, 415, 416, 417, 418, 419, 420, 506, 120B, 34 I.P.C., Police Station- Phase-2 Noida, District- Gautam Budh Nagar (Annexure No. 1 to this writ petition).
(ii) A writ, order or direction in the nature of mandamus commanding the respondents not to arrest the petitioner in pursuance of impugned First Information Report."
At the very outset, Sri Pankaj Bharti, learned counsel for the complainant submits that in the present matter charge-sheet has been submitted against the petitioner nos. 1 to 4, 7 and 8 before the competent court and final report has already been submitted in favour of the the petitioner nos. 5, 6 and 9, as such, the writ petition itself rendered infructuous. Learned counsel for the petitioners has no objection to the same.
Consequently, the writ petition stands dismissed as infructuous.
