Heard Shri Mithilesh Kumar Tiwari, learned counsel for the petitioners; learned Standing Counsel for the State respondent nos.1 and 2 as well as Mohd. Samiuzzaman Khan, appearing for Nagar Palika Parishad, Fatehpur. Shri Sanjeev Singh appears for the contesting respondents.
The petitioners are before this Court with request to issue direction to the first respondent, Additional Commissioner (Administration), Allahabad Division, Allahabad to decide the stay application dated 3.4.2018 filed in Revision No.00512 of 2018, Computerized Case No.C201802000000572 (Ajay Kumar & others vs. Dr. Ashok Kumar Singh and others) within stipulated time.
Learned Standing Counsel fairly states that in case the aforesaid application is still pending and has not been disposed of, the same will be considered and decided expeditiously.
In view of the above, on consent and without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the first respondent to decide the aforesaid revision after giving opportunity of hearing to the private respondent nos.3 to 10, as expeditiously as possible and preferably within a period of six months from the date of production of a certified copy of this order before him, without granting unnecessary adjournments to either of the parties, except upon payment of cost. Till disposal of the revision in question, no third party interest shall be created in the property in question.
