1. Heard Sri D.S. Srivastava, Advocate, for petitioner and learned Standing Counsel for respondents.
2. Petitioner claims to have been engaged on daily wage basis as a Class-IV employee and claims regularization under Group U.P. Regularization of Daily Wages Appointment on Group ‘C’ Posts (Outside the Purview of the Uttar Pradesh Public Service Commission) Rules, 1998 (hereinafter referred to as “Rules, 1998”).
3. In the counter affidavit, respondents have stated in para-8 that petitioner's claim for regularization was considered under Rule, 1998 but he was not found eligible for regularization.
4. Since petitioner has already been considered and not found eligible for regularization and the said order declaring him ineligible for regularization is not under challenge, no relief can be granted.
5. Dismissed.
