Heard learned counsel for the petitioners; learned AGA for the respondent nos. 1, 2 and 3; and perused the record.
The instant petition seeks quashing of the first information report dated 20.11.2018 registered as Case Crime No. 0236 of 2018, under Sections 272, 273 IPC and Sections 60 and 63 of Excise Act, Police Station Ranipur, District Mau.
The allegation in the impugned first information report is that the police upon information that illicit liquor was being manufactured raided poultry farm of co-accused Umesh Singh. Three persons were spotted. Two escaped, but Umesh Singh was apprehended with adulterated liquor and many adulterants. The person arrested on the spot, namely, Umesh Singh is father of petitioner no.2 and he has disclosed identity of the remaining two persons, namely, Ajay Gaund and Shakti Singh (petitioner nos. 1 and 2).
Looking to the allegation as also the recovery made, we do not find any good reason to quash the first information report.
The petition is dismissed.
