Heard learned counsel for the applicant, Sri I.P. Srivastava, the learned AGA for the State and perused the record.
The present bail application has been filed by the applicant in Case Crime No. 92 of 2017, under Section 302 I.P.C., Police Station Jahanaganj, District- Azamgarh with the prayer to enlarge him on bail.
For the purposes of evaluating the prayer for bail, the Court notes that the minor daughters of the applicant are stated to have witnessed the commission of the crime as is evident from the statement recorded under Section 161 Cr.P.C.
Accordingly, while this Court finds no ground to enlarge the applicant on bail, bearing in mind the fact that the charge sheet was submitted as far back as in 2018 and trial has not progressed any further till date and no prosecution witnesses examined, it is only provided that the concerned Court shall endeavour to conclude the trial with expedition and strictly in accordance with the provisions made in Section 309 Cr.P.C.
The application stands disposed of accordingly.
