Heard learned counsel for the petitioner and learned Standing counsel for the State-respondents.
The petition has been filed seeking the following relief-
"i) issue a writ, order or direction in the nature of mandamus commanding the Sub Divisional Officer, Tehsil and District Gautambudh Nagar to decide the suit No.D- 2017112771012348 of 2016 U/s 144 of U.P. Revenue Code, 2006 expeditiously within the time so fixed by the Hon'ble Court."
The petitioner seeks directions for expeditious disposal of his declaratory suit under Section 144 of the U.P. Revenue Code, 2006.
Perusal of the order sheet reveals that the defendants in the suit has put in appearance but their written statement has not been filed till date. It therefore, follows that neither the issues have been framed nor the parties have led their evidence.
Under the circumstances, this writ petition is disposed of directing the respondent no.1, Sub Divisional Officer, Tehsil and District Gautambudh Nagar to endeavour to decide the suit of the petitioner, expeditiously, preferably within a period of ten months from the date a certified copy of this order is filed before him.
