Heard learned counsel for the petitioners and Smt. Manju Thakur, learned A.G.A. for the State-respondents.
This writ petition has been filed praying for the following relief:-
"(i) Issue a writ order or direction in the nature certiorari quashing the impugned FIR dated 14.02.2017, in Case Crime No. 142 of 2017, under Sections 419, 420, 467, 468, 471, 120-B, 406 I.P.C., P.S. Cantt, District Gorakhpur.
"(i) Issue a writ order or direction in the nature mandamus commanding the respondents not to arrest the petitioners in pursuance of the impugned FIR dated 14.02.2017, in Case Crime No. 142 of 2017, under Sections 419, 420, 467, 468, 471, 120-B, 406 I.P.C., P.S. Cantt, District Gorakhpur.
On 28.06.2021, this court passed the following order:-
"Sri Manoj Kumar, learned counsel for the petitioners, Sri H.M.B. Sinha, learned A.G.A. for the State and counsel for respondent no. 4 through video conferencing.
Learned counsel for petitioners and learned counsel for respondent no. 4 submit that the parties have settled their dispute amicably but yet the police is proceeding with the investigation for the reason best known to it.
State counsel prays for and is granted three weeks' time to seek instructions. List this case in the week commencing 26th July, 2021 as fresh".
Learned A.G.A. states on instruction that police has submitted a final report on 03.07.2021.
In view of the aforesaid, we do not find any good reason to keep the writ petition pending. Therefore, writ petition is dismissed as infructuous.
